General Personal Injury Questions

How do I know if I have a personal injury case?

When you contact The Parker Law Group, we will discuss your individual situation in great detail. From there, we will examine the unique circumstances surrounding your situation, and will determine if you have a case. From the very beginning, we will listen to you, explain your rights and address any questions you may have. Together, we will determine the best course of legal action.


How much will it cost to pursue a personal injury case?

It will not cost you anything unless we are successful in recovering monetary damages for you. If and when damages are recovered, The Parker Law Group would then receive a percentage of the total compensation (which would include our legal fees), as well as reimbursement for advanced costs such as investigative services, medical records retrieval, and other specialized services performed which contribute to the settling of your case. 


What kind of compensation is involved in an automobile accident?

The type and degree of compensation will vary, but you may file a claim for physical injuries, medical expenses and lost income, as well as pain and suffering. After reviewing your individual case, we will provide our legal recommendation on the appropriate course of action. 


How do I receive my benefits?

You must notify your insurance agent that you have been in an accident and that you want to make a claim for medical bills. They will then send you or your doctor a Personal Injury Protection (PIP) claim form. Wage loss is handled the same way. 


How long will it take for the insurance company to pay my PIP (Personal Injury Protection) benefits?

PIP Benefits are due 30 days after the claim is submitted. Most policies will pay a maximum of $10,000.00 combined medical expense and wage loss per person, although some policies will pay more. Check your policy under PIP or No Fault Coverage. 


What happens if my injuries are permanent?

If you have suffered permanent injuries, you may make a claim against the at-fault driver for the damages not covered by No Fault Insurance, such as your pain and suffering, loss of the enjoyment of life and any additional wage loss or medical expenses. 


What does No Fault mean to me?

In a No Fault System, each person looks to his/her own auto insurance for the payment of medical bills and lost wages, regardless of fault, when serious but non-permanent injuries result from an automobile accident


Am I required to have No Fault Insurance?

Yes, if you own a car in Florida, No Fault coverage is the only coverage that is required by law. Although to fully protect yourself and your family, you should have the most comprehensive coverage you can afford, including Uninsured Motorist or “UM” coverage. 


Who is covered?

In addition to the named insured, the individual’s spouse and children are also covered if they reside in the same household. The following are also covered: relatives of either the named insured or his/her spouse if residents of the insured’s household, any pedestrian struck by the insured’s vehicle, or any other person using or occupying the insured’s vehicle with the express or implied permission of the named insured or his/her spouse... i.e., lending your car. 


What if the other driver doesn’t have sufficient insurance?

In the case of an uninsured or underinsured driver, you must make a claim against your own Uninsured Motorist (UM) coverage in addition to the other driver’s liability coverage, if any.

What should I bring to my initial consultation?

When you visit us for your complimentary, confidential consultation, be sure to bring all records associated with your case that are in your possession, including medical records, police reports, incident reports, medical bills, photographs and any other documentation that is related to your accident. If you don’t have any of these records, our team will be happy to gather them for you after the initial consultation.
